What are my options?
If you have been injured at work and are not sure what to do next, you are not alone. Coping with a workplace injury can be overwhelming as you try to figure out how you will recover both physically and financially. Simply reporting your injury to your employer does not guarantee you workers’ compensation benefits, as you do not get them automatically. You have not filed a lawsuit until you file a claim for compensation with the Illinois Workers’ Compensation Commission. Reporting an injury and filing a workers’ compensation claim are two different things.
If you have been injured, it is important to do everything in your power to take care of yourself and get your life back on track. This will likely require medical treatment and professional help. Unfortunately, not all employers and insurance companies will work with you to make sure that you get the treatment and help you need. Some will attempt to reduce your payout, while some will even go so far as to try to avoid liability by denying your claim altogether.
